The decision to return the case was made on July 17, the court information system Liteko said.
"The indictment should have been translated and sent to Russia. The criminal case has been received without the Russian translation of the indictment, which should have been sent to Russia along with the request for legal assistance, as the whereabouts of Makutinovich are unknown," Gintautas Stalnionis, spokesman for the court, told BNS.
In June, prosecutors said that they finished the indictment and established 16 episodes, including assaults against border checkpoints, weapon seizure, inflicting injury upon people and shooting episodes.
The Prosecutor General's Office said that Russia refused to extradite Makutinovich and Razvodov and has not responded to a legal assistance request to inform the accused about their right to get acquainted with the pre-trial investigation material.
14 people were killed during an attempt by the Soviet army and special forces, including OMON, to take over Vilnius TV Tower on January 13, 1991, and more than 1,000 unarmed civilians were injured. Seven police and customs officers who guarded the border of Lithuania, then unrecognized by the Soviet Union, were killed at Medininkai border checkpoint in July 1991.
