Uspaskich's lawyer Vytautas Sviderskis submitted a document from Kėdainiai Center of Primary Health Care, saying that Uspaskich had been diagnosed with a duodenum ulcer and he would not be able to attend hearings on Monday and Tuesday.
The panel of judges decided to contact the health institution and obtain information about Uspaskich's condition as well as the duration of his treatment. It was also decided to turn to the health minister.
"It has been decided to turn to the health minister to have it checked based on competence whether he really cannot attend hearings due to his health condition as he is receiving ambulatory care," Judge Daiva Pranytė-Zalieckienė said.
Deputy Speaker of the Seimas Vytautas Gapšys and the party's former accountant Marina Liutkevičienė were supposed to testify on Tueday.
The Labor Party is charged with failing to include more than 24 million litas (EUR 6.9m) in income and 23 million litas in spending into its books between 2004 and 2006.
Uspaskich, Gapšys and MP Vitalija Vonžutaitė are currently standing trial for organizing fraudulent bookkeeping while holding top positions at the Labor Party's Vilnius bureau in 2004-2006. In addition to the three parliamentarians, charges in the case have been brought against the party as a legal entity and its former financial officer Liutkevičienė.
The Labor Party's members strongly deny the accusations, saying the case is politically-motivated. The case reached court back in 2008.
