The Chechen spouses have filed a claim against Lithuania for 27,000 litas (EUR 7,800) in non-pecuniary and 2,000 litas in pecuniary damages, which was caused by what they say was unlawful detention.
The court received the claim back in 2010, but decided to adjourn hearings until completion of criminal proceedings.
Meanwhile, the Gatayev trial pending in Klaipėda court over murder threats, psychological violence, and brutal treatment of their foster children should not be resumed before next February. The spouses will be tried in absentia.
According to media reports, the Chechen couple has been granted asylum in Finland.
In early 2009, a court in Kaunas found the couple guilty of violent treatment of their foster children, murder threats and self-willed conduct. They were each sentenced to 10 months in prison.
Another Kaunas court in September 2009 extended the punishments to 18 months. The Gatayevs went missing after the verdict.
Human rights defenders say there were possible violations in the case - media discussed about interference of the State Security Department and possible involvement of Russia's special services.
