Lithuanian Parliament invalidates election results in Biržai-Kupiškis constituency

The Lithuanian Parliament passed a resolution on Tuesday, annulling election results in Biržai–Kupiškis single-mandate constituency, as advised in the finding of the Constitutional Court.

The resolution was supported by 99 parliamentarians, three voted against and six abstained.

According to the resolution, an MP was not elected in Biržai–Kupiškis electoral area in the parliamentary elections of 14 October 2012. Repeated voting in the area is to be held within six months.

The Central Electoral Commission had approved Aleksandras Zeltinis of the Social Democratic Party as the winner in the constituency, but the Constitutional Court stated the voting violations reported in the area could have compromised the results.

The court said that the recount of votes carried out by the Central Electoral Commission in Kaštonai polling station in the area had established different results from those reported by the area commission. The Constitutional Court said the number of votes between the two top candidates was very small, and the election results could have changed due to faulty vote counting.

Based on conclusions drawn by the Constitutional Court, the final decision on violation of the Law on Elections to the Seimas is made by parliament.

Once the Constitutional Court decided that there had been a gross violation of the Law on Elections to the Seimas and the violation affected the overall election results, the parliament must approve one of the following resolutions: invalidate elections in single-mandate voting or multi-mandate voting or establish the actual election results.
