Restoring old National Minority Law would breach Lithuanian Constitution

Restoring the defunct Law on National Minorities would run counter to the Lithuanian Constitution, lawyers of the parliament say.

In its conclusion on the draft resolution to restore the law, parliament's Department on Law said that "restoring the law, which is no longer valid, is not envisaged in the Constitution, it is not possible and runs counter to Article 7 of the Constitution and the principle of a legal state."

"In law, expiry of a law is treated as elimination of the law from the legal system, consequently, the Law on National Minorities, just like any other law in the legal system of Lithuania, could reappear only as a result of a legislative process," the lawyers said.

The conclusion came in response to a recent proposal by Rita Tamašunienė, elder of the ruling political group of the Electoral Action of Poles in Lithuania, to restore the validity of the law until a new law is drafted and adopted. The MP has registered a draft resolution at the Seimas secretariat, suggesting that the validity of the law, which was adopted by the Supreme Council – Reconstituent Seimas in 1989 and was in effect until 2010.
